Terms of Use of the BabyApp Application

BabyApp is a digital tool intended mainly for parents of children with food allergies or suspected food allergies.

9. Right of Withdrawal

If a user, as a consumer, purchases a Premium subscription remotely (within the application), they generally have the right to withdraw from the contract without giving a reason within 14 days of its conclusion, under Section 1829 of the Czech Civil Code.

Due to the nature of digital content and services, the user may lose this right if, with explicit consent, they begin using the service before the withdrawal period expires (Section 1837(l) of the Czech Civil Code). In such a case, before performance begins, the user acknowledges that by giving this consent they lose the right to withdraw from the contract.

Premium subscription purchases are processed through the Apple App Store or Google Play, which, acting as the seller of the digital content, may have their own rules for withdrawal and refunds. We recommend also reviewing the terms of the relevant platform.

13. Complaints and Alternative Dispute Resolution

If you have a complaint or an issue with a paid service, please contact us at info@babyapp.cz. We will handle your complaint without undue delay, and no later than within 30 days.

If a dispute with the operator cannot be resolved directly, consumers have the right to submit the dispute for out-of-court resolution to the Czech Trade Inspection Authority (Česká obchodní inspekce), Štěpánská 567/15, 120 00 Prague 2, Company ID: 000 20 869, website: adr.coi.cz. The dispute can also be submitted via the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to the Terms

The operator reserves the right to modify these terms at any time. The current version will always be published on babyapp.cz.

15. Governing Law

These terms are governed by the laws of the Czech Republic. Any disputes will be resolved by the competent courts of the Czech Republic.
